Terms of Use
1. Who we are
Mist is provided by ezzio.nl, the Netherlands (“we”). Contact: privacy@ezzio.nl. By using Mist you agree to these terms.
2. The software
The Mist app is free. You may use it for personal and commercial purposes. You may not resell it, or distribute modified versions presented as Mist.
Mist is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted availability or freedom from bugs. We may change, pause or stop Mist, sync or the AI assistant at any time.
3. Your responsibilities
- You are responsible for the servers you connect to, for having permission to access them, and for what you do on them.
- You are responsible for keeping your devices, credentials, keys, master password and recovery key safe. Because sync is end-to-end encrypted, we cannot recover your data if you lose both your master password and your recovery key.
- Keep your own backups of important data. Sync is not a backup.
4. Acceptable use
You must not use Mist or our servers to:
- access systems without authorization, or attack, scan or disrupt systems you don't own or have permission to test;
- abuse, overload or try to break into the Mist server, or bypass its limits;
- break any law.
5. Mist Pro and the AI assistant
- Mist Pro, which includes the AI assistant, is currently in early access and available by invitation only. There is no payment yet. Payment terms will be added to these terms before paid sales start.
- Usage is limited, currently to 300 AI requests per day. Limits may change.
- AI suggestions are provided “as is” and can be wrong, incomplete or unsafe. You must review every suggested command before running it. Mist never runs AI-suggested commands automatically — you decide by pressing Enter yourself.
- You must not use the AI assistant to attack systems, gain unauthorized access, create malware, or get around security or usage restrictions (including those of our AI provider). We may suspend your access to the AI assistant or Mist Pro if you misuse it.
- How AI requests are processed is described in the Privacy Policy, section 6.
6. Your account
An account is optional. You can delete it at any time — see Delete account. We may suspend or close an account that breaks these terms or threatens the security of the service. Where reasonable, we will tell you first and give you the chance to export your data.
7. Liability
To the extent permitted by Dutch law, we are not liable for any damage arising from the use of or inability to use Mist, including loss of data, loss of profit or damage to your systems. Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence (opzet of bewuste roekeloosheid), or your mandatory rights as a consumer.
8. Privacy
How we handle personal data is described in the Privacy Policy.
9. Changes
We may update these terms. The current version is always on this page, with the date below. If you keep using Mist after a change, the new terms apply.
10. Law and disputes
These terms are governed by Dutch law. Disputes go to the competent court in the Netherlands, unless mandatory consumer law gives you the right to go to a court in your own country.
